ALGEMENE VOORWAARDEN
Lees hieronder de algemene voorwaarden die van toepassing zijn op alle evenementen van de National Hockey Academy.

Artikel 1 - Definities
In deze algemene voorwaarden, hierna te noemen “Algemene Voorwaarden”, die zijn te raadplegen via de website www.nationalhockeyacademy.com, wordt verstaan onder:
1.1a. De “National Hockey Academy” is een handelsnaam van SportWays b.v., gevestigd te Amsterdam; hierna verder te noemen de “National Hockey Academy”, actief in Nederland
1.1b. De “National Hockey Academy”, is een handelsnaam van The Hockey World b.v., gevestigd te Antwerpen; hierna verder te noemen de “National Hockey Academy”, actief in België
1.2. “Deelnemer”: de natuurlijke persoon die ingevolge de Overeenkomst tussen de National Hockey Academy en Opdrachtgever gebruik maakt van een Evenement van de National Hockey Academy.
1.3. “Inschrijfformulier”: het formulier op de Website van de National Hockey Academy.
1.4. “Opdrachtgever”: de natuurlijke persoon of rechtspersoon die de Overeenkomst met de National Hockey Academy aangaat.
1.5. “Overeenkomst”: de overeenkomst tussen de National Hockey Academy en Opdrachtgever ter zake van deelname door Deelnemer aan een Evenement van de National Hockey Academy.
1.6. Deelnamesom”: de totale som, exclusief afkoop annuleringsrisico, van een of meer door de National Hockey Academy ten behoeve van Opdrachtgever en Deelnemer te verlenen diensten.
1.7. “Evenement”: een door de National Hockey Academy georganiseerd Trainingsblok dan wel Trainingssessie, zoals nader gedefinieerd bij het aanbod van de National Hockey Academy op de Website en het Inschrijfformulier.
1.8. “Trainingsblok”: een door de National Hockey Academy georganiseerd blok van meerdere Trainingssessies, zoals aangegeven bij het aanbod van de National Hockey Academy op de Website en het Inschrijfformulier.
1.9. “Trainingssessie”: een door de National Hockey Academy georganiseerde training, vaak onderdeel van een Trainingsblok.
1.10. “Website”: de website van de National Hockey Academy, zijnde de url’s: https://www.nationalhockeyacademy.com/, https://www.nationalhockeyacademy.be/
1.11. “Stationmanager”: eindverantwoordelijke op Evenement aangewezen door de National Hockey Academy.
Artikel 2 - Toepasselijkheid
2.1. Deze Algemene Voorwaarden zijn van toepassing op alle door de National Hockey Academy gedane aanbiedingen, opdrachtbevestigingen en daaruit voortvloeiende of daarmee verband houdende overeenkomsten of nadere overeenkomsten.
2.2. De National Hockey Academy stemt uitdrukkelijk niet in met de toepasselijkheid van enige algemene (en/of specifieke) voorwaarden en/of bedingen van de Opdrachtgever en/of Deelnemer.
2.3. Afwijkingen van of aanvullingen op - in welke vorm dan ook - de Overeenkomst of de Algemene Voorwaarden gelden slechts indien de National Hockey Academy daar vooraf schriftelijk mee heeft ingestemd.
2.4. Ingeval van strijd tussen de bepalingen van de Algemene Voorwaarden en/of bepalingen uit de Overeenkomst prevaleren de laatste.
2.5. Mocht enige bepaling van deze Algemene Voorwaarden niet van toepassing zijn of in strijd zijn met de Openbare Orde of de Wet, dan zal slechts de desbetreffende bepaling als niet geschreven worden beschouwd en zullen de overige Algemene Voorwaarden volledig van kracht blijven.
2.6. De National Hockey Academy is te allen tijde gerechtigd om deze Algemene Voorwaarden en/of de Overeenkomst eenzijdig te wijzigen.
2.7. De National Hockey Academy is te allen tijde gerechtigd om de prijzen van een Evenement te wijzigen. Het kan voorkomen dat een Evenement tijdelijk voor een lagere of hogere Deelnamesom wordt aangeboden. Dit geeft geen recht op restitutie.
Artikel 3 - Aanmelding
3.1. Alle aanbiedingen van de National Hockey Academy zijn vrijblijvend en onder het voorbehoud van aanwezige capaciteit, tenzij uitdrukkelijk anders overeengekomen.
3.2. De Overeenkomst komt tot stand nadat Opdrachtgever het Inschrijfformulier, te vinden op de Website, digitaal heeft ingezonden.
3.3. Bij aanmelding via het internet is er sprake van 14 dagen bedenktijd i.v.m. aankoop op afstand. Binnen deze periode mag de aanmelding kosteloos worden geannuleerd zonder opgaaf van reden, mits dit schriftelijk, geadresseerd aan info@nationalhockeyacademy.com, gebeurt.
3.4. Bij eventuele wijzigingen na 14 dagen van de bevestigingsdatum wordt € 7,75 administratiekosten in rekening gebracht.
3.5 National Hockey Academy behoudt altijd het recht om wijzigingen aan te brengen binnen een Overeenkomst op basis van het kwaliteitsniveau van de Deelnemers per Trainingsblok geheel naar eigen inzicht van de leiding van de National Hockey Academy.
Artikel 4 - Betaling
4.1. Betaling dient plaats te vinden binnen 14 dagen na ontvangst van de digitale reserveringsbevestiging van National Hockey Academy en vóór aanvang van de eerste Trainingssessie van het Trainingsblok.
4.2. Indien een voor zover tijdige betaling achterwege blijft, is Opdrachtgever van rechtswege in verzuim, zonder dat enige ingebrekestelling vereist zal zijn.
4.3. Bij niet tijdige betaling behoudt de National Hockey Academy zich het recht voor de Overeenkomst te annuleren en is Opdrachtgever met inachtneming van het bepaalde in Artikel 12 lid 2 of Artikel 12 lid 3 van deze Algemene Voorwaarden aansprakelijk voor de annuleringskosten.
Artikel 5 - Gedragsregels
5.1. Deelnemer is verplicht tot naleving van alle redelijke aanwijzingen van de National Hockey Academy ter bevordering van een goede uitvoering van de Overeenkomst. Tevens dient Deelnemer de gedragsregels te respecteren welke de National Hockey Academy nageleefd wenst te zien tijdens het verblijf op accommodaties uit hoofde van de Overeenkomst. Vooraf opgestelde gedragsregels gedefinieerd op de Website.
5.2. Deelnemer die hinder of overlast oplevert of kan opleveren, zodanig dat een goede uitvoering van de Overeenkomst door de National Hockey Academy in sterke mate wordt bemoeilijkt, kan door de National Hockey Academy van - verdere deelname aan - het Evenement worden uitgesloten. Dit is ter beoordeling van de stationmanager van het Evenement. Opdrachtgever en/of Deelnemer hebben in dit geval geen recht op restitutie van - een deel van - de betaling voor deelname aan het betreffende Evenement. Alle daaruit voortvloeiende kosten en schade komen voor rekening van Opdrachtgever en/of Deelnemer.
Artikel 6 - Privacy
6.1. Opdrachtgever en Deelnemer stemmen ermee in dat (persoons)gegevens die Opdrachtgever van Opdrachtgever en Deelnemer verstrekt aan de National Hockey Academy mogen worden gebruikt voor onder meer, maar niet beperkt tot, redactionele, commerciële en promotionele doeleinden rondom Evenementen van de National Hockey Academy en het doen van gerichte aanbiedingen van partners van de National Hockey Academy.
6.2. Opdrachtgever en Deelnemer hebben het recht om de door de National Hockey Academy verwerkte (persoons)gegevens van Opdrachtgever en Deelnemer in te zien.
6.3. Op schriftelijk verzoek van Opdrachtgever en/of Deelnemer zullen de door de National Hockey Academy verwerkte (persoons)gegevens van Opdrachtgever en Deelnemer worden verwijderd uit de database van de National Hockey Academy.
Artikel 7 - Beeld- en geluidsmateriaal
7.1. Opdrachtgever en Deelnemer stemmen ermee in dat tijdens en/of rondom Evenementen van de National Hockey Academy waaraan Deelnemer deelneemt geluidsopname(s), foto(‘s) en/of video(‘s) worden gemaakt met daarop de herkenbare afbeelding van Opdrachtgever en/of Deelnemer en dat deze door de National Hockey Academy gemaakte geluidsopname(s), foto(‘s) en/of video(‘s) door de National Hockey Academy mogen worden gebruikt voor alle doeleinden, waaronder maar niet beperkt tot, redactionele, commerciële en/of promotionele doeleinden.
7.2. Opdrachtgever en/of Deelnemer dragen onvoorwaardelijk alle rechten, die hij/zij op de in lid 1 van dit artikel genoemde geluidsopname(s), foto(‘s) en/of video(‘s) zou(den) kunnen doen gelden over aan de National Hockey Academy.
7.3. Als Opdrachtgever en/of Deelnemer niet instemmen met het maken en/of het gebruiken van de geluidsopname(s), foto(‘s) en/of video(‘s) als bedoeld in lid 1 in dit artikel, dan dienen Opdrachtgever en/of Deelnemer de National Hockey Academy hier voorafgaand aan het betreffende Evenement van de National Hockey Academy schriftelijk, gericht aan info@nationalhockeyacademy.com, op de hoogte te stellen.
Artikel 8 - Gevonden voorwerpen
8.1. Gevonden voorwerpen blijven na afloop van de Trainingssessie of het Trainingsblok liggen op de desbetreffende locatie van het Trainingsblok.
Artikel 9 - Aansprakelijkheid National Hockey Academy
9.1. De National Hockey Academy sluit - behoudens ingeval van schade veroorzaakt door opzet en/of grove schuld van de National Hockey Academy - iedere aansprakelijkheid voor schade aan sportuitrusting, bagage en/of andere persoonlijke eigendommen van Deelnemer, al dan niet in bewaring gegeven aan de National Hockey Academy, als gevolg van diefstal, verlies en/of beschadiging uit.
9.2. Deelname aan een Evenement van de National Hockey Academy - behoudens in geval van schade veroorzaakt door opzet en/of grove schuld van de National Hockey Academy - is geheel voor eigen risico van Opdrachtgever en/of Deelnemer. De National Hockey Academy sluit alle aansprakelijkheid als gevolg van letsel, blessures, lichamelijke klachten of ongemakken in de meest brede zin van het woord, die zijn ontstaan tijdens of als gevolg van een National Hockey Academy Evenement, volledig uit en is op geen enkele wijze gehouden tot vergoeding van schade en/of kosten noch restitutie van de kosten van deelname.
9.3. De National Hockey Academy aanvaardt geen aansprakelijkheid voor schade waarvoor aanspraak op vergoeding bestaat uit hoofde van een reis- en ongevallenverzekering of uit hoofde van een (aansprakelijkheids)verzekering van derden die door de National Hockey Academy bij de uitvoering van de Overeenkomst zijn betrokken.
9.4. De National Hockey Academy aanvaardt - behoudens in geval van individueel vervoer door de National Hockey Academy zelf of behoudens opzet of grove schuld van de National Hockey Academy - geen aansprakelijkheid voor het vervoer van Deelnemer. Deelnemer dient zich in voorkomend geval te wenden tot de betreffende vervoerder. Op verzoek van Deelnemer en/of Opdrachtgever zal de National Hockey Academy de naam van de betreffende vervoerder verstrekken.
9.5. Onverminderd het bepaalde in de voorgaande leden van dit artikel, is iedere aansprakelijkheid van de National Hockey Academy beperkt tot het bedrag waarop in het desbetreffende geval uit hoofde van zijn (aansprakelijkheidsverzekering(en) aanspraak bestaat.
9.6. De teksten, foto’s en video’s op de Website beschrijven zo goed en nauwkeurig mogelijk wat een National Hockey Academy Evenement inhoudt. Ondanks deze zo waarheidsgetrouw mogelijke weergave van een National Hockey Academy Evenement, is deze weergave niet bindend. Mogelijke afwijkingen hiervan - om wat voor reden dan ook - zijn mogelijk.
Artikel 10 - Aansprakelijkheid Opdrachtgever en/of Deelnemer
10.1. Opdrachtgever is hoofdelijk aansprakelijk voor alle schade die voor de National Hockey Academy en/of enige derde is/zal ontstaan als direct of indirect gevolg van een toerekenbare tekortkoming - niet naleving van de gedragsregels zoals beschreven in Artikel 5 van deze Algemene Voorwaarden - van Deelnemer.
10.2. Opdrachtgever zal de National Hockey Academy vrijwaren tegen aanspraken van derden tot vergoeding van schade welke voortvloeien uit of verband houden met het gebruik van Deelnemer van faciliteiten en/of diensten ingevolge de Overeenkomst.
Artikel 11 - Overmacht, wijziging of annulering door de National Hockey Academy
11.1. Indien de National Hockey Academy door overmacht geheel of ten dele is verhinderd een of meer voor zijn uit de Overeenkomst voortvloeiende verplichtingen na te komen, is de National Hockey Academy gerechtigd om een naar zijn oordeel gelijkwaardig alternatief, zoals beschreven in lid 3 van dit artikel, aan te bieden dan wel de Overeenkomst zonder gerechtelijke tussenkomst geheel of gedeeltelijk op te schorten, middels een National Hockey Academy voucher, beschreven in Artikel 15 van deze Algemene Voorwaarden, of te doen ontbinden, zonder dat de National Hockey Academy tot enige schadevergoeding jegens Opdrachtgever is gehouden.
11.2. Onder overmacht, zoals bedoeld in lid 1 van dit artikel, wordt onder meer verstaan, maar niet beperkt tot:
a. De omstandigheid dat door de National Hockey Academy ingeschakelde derden zoals leveranciers, hockeyclubs, (sport)accommodaties, transporteurs of andere partijen waarvan de National Hockey Academy afhankelijk is, niet of niet tijdig voldoen aan hun verplichtingen;
b. Weersomstandigheden, natuurgeweld, pandemieën, terrorisme, cybercriminaliteit, verstoringen van de (digitale) infrastructuur, wegblokkades, stakingen of werkonderbrekingen en reis- en handelsbeperkingen;
c. Onvoldoende aanmeldingen voor deelname aan een Trainingsblok, waar sprake van is als het aantal inschrijvingen minder bedraagt dan 8 deelnemers;
d. Onvoldoende aanmeldingen voor deelname aan een Trainingssessie, waar sprake van is als het aantal inschrijvingen minder bedraagt dan 8 deelnemers.
11.3. Onder een gelijkwaardig alternatief wordt onder meer verstaan, maar niet beperkt tot, Evenementen in dezelfde prijsklasse, dezelfde periode en dezelfde leeftijdsgroep.
Artikel 12 - Annulering door Opdrachtgever
12.1. Annulering dient schriftelijk, gericht aan info@nationalhockeyacademy.com, te geschieden, waarbij de datum van de annuleringsmail als peildatum zal dienen voor het bepaalde in lid 2 of lid 3 van dit artikel.
12.2. Bij annulering van de Overeenkomst van een Evenement van de National Hockey Academy worden per Deelnemer de volgende bedragen in rekening gebracht:
a. Op de dag van aanvang van het Evenement en tijdens het Evenement 100% van de gehele Deelnamesom.
b. Vanaf de 7de dag (inclusief) tot de dag van aanvang van het Evenement 50% van de gehele Deelnamesom.
12.3. In geval van annulering is Deelnemer gerechtigd een ander persoon in zijn plaats te doen stellen. Er wordt dan €25,00 administratiekosten in rekening gebracht.
Artikel 13 - Wijzigingen door Opdrachtgever
13.1. Opdrachtgever en/of Deelnemer heeft het recht om tot en met 14 dagen na het afsluiten van de Overeenkomst kosteloos wijzigingen aan te brengen in de Overeenkomst.
Artikel 14 - National Hockey Academy Voucher
14.1. Een National Hockey Academy Voucher is een waardebon.
14.2. Indien het evenement is geannuleerd vanwege onvermijdbare en buitengewone omstandigheden, zoals beschreven in Artikel 11 lid 1 van deze Algemene Voorwaarden, dan kan de National Hockey Academy een zogenoemde Voucher uitschrijven.
14.3. De waarde van de National Hockey Academy Voucher is gelijk aan de Deelnamesom, en indien geboekt inclusief de kosten van de reis- en ongevallenverzekering, die betaald is door Opdrachtgever en/of Deelnemer op het moment van uitgifte van de voucher.
14.4. De National Hockey Academy Voucher is uitsluitend geldig voor alle Evenementen die georganiseerd worden door de National Hockey Academy.
14.5. De National Hockey Academy Voucher is voor twee aaneengesloten kalenderjaren geldig, vanaf de datum van uitgifte.
14.6. Indien Opdrachtgever en/of Deelnemer de voucher niet gebruikt, dan heeft Opdrachtgever en/of Deelnemer het recht om vanaf 12 maanden na uitgifte van de voucher een volledige restitutie aan te vragen.
14.7. De National Hockey Academy Voucher is overdraagbaar aan een andere deelnemer voor een National Hockey Academy Evenement, zoals beschreven in Artikel 12 lid 3 van deze Algemene Voorwaarden.
14.8. Wanneer Opdrachtgever en/of Deelnemer de voucher gebruikt voor hetzelfde type Evenement, dan worden eventuele prijswijzigingen niet verrekend.
Artikel 15 - Klachten en onvolkomenheden
15.1. Klachten en onvolkomenheden moeten altijd eerst gemeld worden door Opdrachtgever en/of Deelnemer bij de Stationmanager van het Evenement, zodat het ter plekke opgelost kan worden.
15.2. Indien de klacht of onvolkomenheid niet naar behoren wordt opgelost, dan moet Opdrachtgever en/of Deelnemer de Stationmanager van het Evenement een schriftelijk verslag laten maken.
15.3. Een klacht of onvolkomenheid dient binnen twee weken na afloop van het Evenement schriftelijk ingediend te worden via info@nationalhockeyacademy.com. In deze schriftelijke klacht staat in ieder geval:
a. Datum van de klacht, naam, telefoonnummer(s) en mailadres;
b. Naam, telefoonnummer(s) en mailadres van klager(s);
c. Naam van Opdrachtgever en Deelnemer;
d. Naam, locatie en data van het Evenement;
e. Type en omschrijving van de klacht:
f. Een kopie van het schriftelijk verslag van de stationmanager..
15.4. Een klacht zal zo snel mogelijk, maar in ieder geval binnen drie weken na ontvangst, schriftelijk worden beantwoord.
15.5. Indien een klacht niet behandeld wordt binnen de termijn, genoemd in lid 4 van dit artikel, zendt de National Hockey Academy binnen deze termijn een ontvangstbevestiging en noemt een nieuw termijn waarbinnen een antwoord kan worden verwacht.
15.6. Klachten en onvolkomenheden die na terugkomst worden ingediend door Opdrachtgever en/of Deelnemer zonder dat deze schriftelijk zijn vastgelegd door de Stationmanager of van het desbetreffende Evenement, worden niet in behandeling genomen
Artikel 16 - Toepasselijk recht
16.1. Op de Overeenkomst en alle overeenkomsten die daaruit voortvloeien is uitsluitend Nederlands recht van toepassing.
16.2. Alle geschillen die naar aanleiding van de Overeenkomst of daaruit voortvloeiende overeenkomsten tussen partijen mochten ontstaan, zullen worden beslecht door de bevoegde rechter van de rechtbank te Amsterdam met betrekking tot Nederland en van de rechtbank te Antwerpen met betrekking tot België.

Article 1 - Definitions
In these general terms and conditions, hereinafter referred to as "General Terms and Conditions", which can be consulted on the website of National Hockey Academy, the following terms are understood to mean:
1.1a. "National Hockey Academy"(the Netherlands): National Hockey Academy b.v., known under the trade name National Hockey Academy, established in Amsterdam.
1.1b. “National Hockey Academy”(Belgium): The Hockey World b.v., known under the trade name The Hockey World, established in Antwerp.
1.2. "Participant": the natural person who under the Agreement between National Hockey Academy and Principal participates in an Event organised by National Hockey Academy.
1.3. "Registration Form": the form on the Website of National Hockey Academy.
1.4. "Principal": the natural person or legal entity who enters into the Agreement with National Hockey Academy.
1.5. "Agreement": the agreement between National Hockey Academy and Principal with regard to participation by Participant in an Event organised by National Hockey Academy.
1.6. "Travel Sum": the total sum, excluding insurance and surrender cancellation risk, due for one or more services to be provided by National Hockey Academy for the benefit of the Principal and Participant.
1.7 "Event": a Training session or Training period organised by National Hockey Academy, as further defined in the offer of National Hockey Academy on the Website and the Registration Form.
1.8. "Website": the website of National Hockey Academy, identified by the url: www.nationalhockeyacademy.com, https://www.nationalhockeyacademy.be/
1.9. “Training period”: a block of multiple Training sessions organised by National Hockey Academy, as further defined in the offer of National Hockey Academy on the website van the Registration form.
1.10. “Training session”: a training organised by National Hockey Academy.
1.11. “ Stationmanager”: responsible during an Event appointed by the National Hockey Academy
Article 2 - Applicability
2.1. These General Terms and Conditions apply to all offers made by National Hockey Academy, confirmations of orders and any ensuing or related agreements or further agreements.
2.2. National Hockey Academy expressly excludes the applicability of any General (and/or specific) Terms and Conditions and/or stipulations of the Principal and/or Participant.
2.3. Deviations from or additions to - in whatever form - the Agreement or the General Terms and Conditions shall only apply if National Hockey Academy has given its prior written consent.
2.4. In case of a conflict between the provisions of the General Terms and Conditions and/or provisions of the Agreement, the latter shall prevail.
2.5. If any provision of these General Terms and Conditions is not applicable or contrary to Public Order or Legislation or the Law, only the relevant provision will be considered as not written and the other General Terms and Conditions will remain valid in full force.
2.6. National Hockey Academy is entitled to amend these General Terms and Conditions and/or the Agreement unilaterally at all times.
2.7. National Hockey Academy is entitled to change the prices of an Event at all times. An Event may be temporarily offered for a lower or higher Travel Sum. This does not entitle a refund.
Article 3 - Registration
3.1. All offers of National Hockey Academy are without obligation and subject to the available capacity, unless expressly agreed otherwise.
3.2. The Agreement shall be concluded after Principal has digitally submitted the Registration Form, to be found on the Website.
3.3. In case of registration via internet, a 14-day reflection period in relation to a remote purchase applies. Within this reflection period, registration may be cancelled free of charge without giving a reason, provided this is submitted in writing, addressed to info@nationalhockeyacademy.com
3.4. In case of any changes made after 14 days of the confirmation date, an administration fee of €7.75 will be charged.
3.5 The National Hockey Academy reserves the right to makes changes within the Agreement based on the quality level of Participant for each Trainings period.
Article 4 - Payment
4.1. Payment must be made within 14 days after receipt of the digital booking confirmation sent by National Hockey Academy and before the start of the first Training session.
4.2. If and to the extent that timely payment is not made, the Principal is legally in default, without any notice of default being required.
4.3. In case of non-timely payment, National Hockey Academy reserves the right to cancel the Agreement and the Principal will be liable for the cancellation costs in accordance with the provisions of Article 12 paragraph 2 or Article 12 paragraph 3 of these General Terms and Conditions.
Article 5 - Code of conduct
5.1. The Participant is obliged to comply with all reasonable instructions of National Hockey Academy to promote a proper fulfilment of the Agreement. Participant must also respect the code of conduct which National Hockey Academy wishes to see observed during the stay at accommodations under the Agreement.
5.2. A Participant who causes or may cause nuisance or inconvenience, in such a way that a proper fulfilment of the Agreement by National Hockey Academy is severely hindered, can be excluded by National Hockey Academy from - further participation in - the Event. This is at the discretion of the Event Manager of the Event. In this case, Principal and/or Participant are not entitled to a refund of - part of - the payment for participation in the relevant Event. All resulting costs and damages shall be for the expense of the Principal and/or Participant.
Article 6 - Privacy
6.1. Principal and Participant agree that (personal) data provided by Principal and Participant to National Hockey Academy may be used to the extent necessary for the fulfilment of the Agreement and related purposes, including, but not limited to, editorial, commercial and promotional purposes related to Events of National Hockey Academy, analysis purposes and making targeted offers.
6.2. Principal and Participant agree that (personal) data provided by Principal and Participant to National Hockey Academy may be used for, but not limited to, editorial, commercial and promotional purposes relating to National Hockey Academy Events and making targeted offers from partners of National Hockey Academy: The Hockey World b.v. and National Hockey Academy b.v..
6.3. Principal and Participant have the right to view the (personal) data of Principal and Participant processed by National Hockey Academy.
6.4. On the written request of Principal and/or Participant, the (personal) data of Principal and Participant processed by National Hockey Academy will be removed from the database of National Hockey Academy.
Article 7 - Images and audio material
7.1. Principal and Participant agree that during and/or around Events of National Hockey Academy in which Participant participates, audio recording(s), photo(s) and/or video(s) may be made with the recognisable image of Principal and/or Participant and that these audio recording(s), photo(s) and/or video(s) made by National Hockey Academy may be used by National Hockey Academy for all purposes, including but not limited to editorial, commercial and/or promotional purposes.
7.2. Principal and/or Participant unconditionally transfer all rights to the audio recording (s), photo (s) and/or video (s) stated in paragraph 1 of this article to National Hockey Academy.
7.3. If Principal and/or Participant do not agree with audio recording(s), photo(s) and/or video(s) being made or used as referred to in paragraph 1 of this article, Principal and/or Participant must inform National Hockey Academy in writing, prior to the relevant Event of National Hockey Academy addressed to info@nationalhockeyacademy.com
Article 8 – Lost property
8.1. Lost property from the Training session of National Hockey Academy will be held on the location of the Event.
Article 9 - Liability of National Hockey Academy
9.1. National Hockey Academy excludes - except in case of damage caused by intent and/or gross negligence of National Hockey Academy - any liability for damage to luggage and/or other personal property of Participant, whether or not deposited with National Hockey Academy, as a result of theft, loss and/or damage.
9.2. Participation in an Event of National Hockey Academy - except in case of damage caused by intent and/or gross negligence of National Hockey Academy - is entirely at the risk of the Principal and/or Participant. National Hockey Academy excludes all liability as a result of injuries, physical complaints or inconvenience in the broadest sense of the word, which have occurred during or as a result of a National Hockey Academy Event, completely and is in no way liable for compensation of damages and/ or costs nor refund of the costs of participation.
9.3. National Hockey Academy accepts no liability for damage for which a claim for compensation exists under a travel and accident insurance or under a (liability) insurance of third parties involved by National Hockey Academy in the fulfilment of the Agreement.
9.4. National Hockey Academy accepts - except in case of individual transport by National Hockey Academy itself or except in case of intent or gross negligence of National Hockey Academy - no liability for the transport of Participant. Participant should, where appropriate, submit a claim with the relevant carrier. National Hockey Academy will provide the name of the carrier on the request of Participant and/or Principal.
9.5. Without prejudice to the provisions stated in the preceding paragraphs of this article, any liability of National Hockey Academy is limited to the amount to which, in the case in question, a claim exists under its (liability) insurance(s).
9.6. The texts, images and videos on the Website describe the content of a National Hockey Academy Event as well and accurately as possible. Despite the fact that they represent a National Hockey Academy Event as faithfully as possible, this representation is not binding. Possible deviations - for whatever reason - are possible.
Article 10 - Liability of Principal and/or Participant
10.1. Principal is jointly and severally liable for all damage that has/will arise for National Hockey Academy and/or any third party as a direct or indirect result of an attributable shortcoming - non-compliance with the code of conduct as described in Article 5 of these General Terms and Conditions – of the Participant.
10.2. Principal shall indemnify National Hockey Academy against claims by third parties for compensation of damages resulting from or related to the use of facilities and/or services by the Participant under the Agreement.
Article 11 - Force majeure, amendment or cancellation by National Hockey Academy
11.1. If, due to force majeure, National Hockey Academy is wholly or partially prevented from fulfilling one or more of its obligations under the Agreement, National Hockey Academy is entitled to offer an alternative, as described in paragraph 3 of this article, or to suspend the Agreement in whole or in part without judicial intervention, by means of a National Hockey Academy voucher, described in Article 15 of these General Terms and Conditions, or to have the Agreement terminated, without National Hockey Academy being obliged to pay any compensation to the Principal.
11.2. Force majeure, as referred to in paragraph 1 of this article, includes, but is not limited to: a. The circumstance that third parties engaged by National Hockey Academy, such as suppliers, hockey clubs, (sports) accommodations, carriers or other parties on which National Hockey Academy depends, fail to meet their obligations, or fail to meet their obligations in a timely manner;
b. Weather conditions, natural disasters, pandemics, terrorism, cybercrime, disruptions to the (digital) infrastructure, roadblocks, strikes or interruptions of work and travel and trade restrictions;
c. Insufficient registrations for participation at a hockey camp, which is the case if the number of registrations is less than 30 participants.
11.3. An equivalent alternative includes, but is not limited to, Events in the same price range, period and age group.
Article 12 - Cancellation by Principal
12.1. Cancellation must be stated in writing, addressed to info@nationalhockeyacademy.com, with the date of the cancellation email serving as the reference date for the provisions of paragraph 2 or paragraph 3 of this article.
12.2. In case of cancellation of the Agreement of an Event of National Hockey Academy, the following sums will be charged per Participant:
a. From the 7nd day (inclusive) until the start of the Event, 50% of the total Travel Sum;
b. From the 5th day (inclusive) until the day of commencement of the Event and during the Event, 100% of the total Travel Sum.
12.3. In the event of cancellation, the Participant is entitled to designate another person to take his/her place. An administration fee of €25.00 will be charged.
Article 13 - Amendments by the Principal
13.1. Principal and/or Participant is entitled to make amendments to the Agreement free of charge up to and including 14 days after the conclusion of the Agreement.

Article 14 - National Hockey Academy Voucher
14.1. A National Hockey Academy Voucher is a voucher.
14.2. If the event has been cancelled due to unavoidable and extraordinary circumstances, as described in Article 11.1. of these Terms and Conditions, National Hockey Academy may issue a so-called voucher.
14.3. The value of the National Hockey Academy voucher is equal to the Travel Sum, and if booked includes the costs of the Surrender Cancellation Risk and/or travel and accident insurance, which has been paid by Principal and/or Participant at the time the voucher was issued.
14.4. The National Hockey Academy voucher is only valid for all Events organised by National Hockey Academy.
14.5. The National Hockey Academy voucher is valid for two consecutive calendar years from the date of issue.
14.6. If Principal and/or Participant does not use the voucher, Principal and/or Participant is entitled to apply for a full refund from 12 months after the date of issue of the voucher.
14.7. The National Hockey Academy voucher is transferable to another participant for a National Hockey Academy Event, as described in Article 12.3. of these General Terms and Conditions.
14.8. When Principal and/or Participant uses the voucher for the same type of Event, any price modifications will not be settled.

Article 15 - Complaints and shortcomings
15.1. Complaints and shortcoming must always first be reported by Principal and/or Participant to the Stationmanager of the Event, so that the issue can be resolved on the spot.
15.2. If the complaint or shortcoming is not resolved properly, Principal and/or Participant must request the Stationmanager of the Event to make a written report.
15.3. A complaint or shortcoming must be submitted in writing within two weeks after the end of the Event via info@nationalhockeyacademy.com. This written complaint must state in any case:
a. Date of the complaint, name, telephone number(s) and e-mail address;
b. Name, telephone number(s) and e-mail address of the complainant(s);
c. Name of Principal and Participant;
d. Name, location and dates of the Event;
e. Type and description of the complaint:
f. A copy of the written report of the camp leadership.
15.4. A complaint will be answered in writing as soon as possible, but in any case within three weeks after it has been received.
15.5. If a complaint is not dealt with within the period as stated in paragraph 4 of this article, National Hockey Academy will send an acknowledgement of receipt within this period and state a new period within which a response can be expected.
15.6. Complaints and shortcomings that are submitted after the return of Principal and/or Participant without having been recorded in writing by the Supervisor or Technical Director of the relevant Event, will not be dealt with.
Article 16 - Applicable law
16.1. The Agreement and all agreements resulting therefrom shall be governed exclusively by Dutch law.
16.2. All disputes that may arise between the parties as a result of the Agreement or agreements arising therefrom shall be settled by the competent court of the District Court of Amsterdam or the District Court of Antwerp.
16.3. In the event of a conflict between the translation of the text of these General Terms and Conditions and the Dutch version, the original Dutch version will always take precedence.
